US Judge Mandates Freedom of Abrego Garcia from ICE Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without legal authority.

"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation originates in a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to face alien smuggling allegations, he was detained in immigration custody.

In her decision, the court noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The court proceedings center on disputed assertions. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
